You understand and agree that we do not guarantee any specific outcome or result from the use of our Services. The recommendations and guidance we provide are based on our professional expertise and the information you provide. You are solely responsible for the implementation of our advice and the results thereof. Our role is to advise and consult; the ultimate success of your project depends on your own efforts and various market factors beyond our control.

Both parties agree to keep all non-public information obtained from the other party (“Confidential Information”) in confidence. We will not disclose your Confidential Information to any third party without your prior written consent, except as required by law. Likewise, you agree not to disclose any of our proprietary methods, tools, or materials provided as part of the Services.

To the maximum extent permitted by law, Synnovai , ITS OWNERS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, resulting from (a) your use of our Services or your inability to use our Services; (b) any decisions you make based on the advice or information provided.

Any dispute arising out of or relating to these Terms, including the breach, termination, enforcement, interpretation, or validity thereof, shall be resolved by final and binding individual arbitration in Concord, CA before a single arbitrator. The arbitration shall be administered by the American Arbitration Association (AAA) in accordance with the Commercial Arbitration Rules. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.

CLASS ACTION WAIVER: You and Synnovai agree that each may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this Site. You are advised to review these Terms periodically for any changes. Your continued use of the Site or Services after the posting of changes constitutes your acceptance of such changes.

WE MAKE NO WARRANTY REGARDING THE ACCURACY, TIMELINESS, TRUTHFULNESS, COMPLETENESS, OR RELIABILITY OF ANY CONTENT OBTAINED THROUGH THE SERVICES. YOUR USE OF THE SERVICES IS AT YOUR OWN RISK.

You have the right to post, upload, share, or otherwise communicate your opinions and experiences, which may include reviews, complaints, or recommendations, on any interactive publicly available website or third-party site without penalty, so long as your statements are truthful and do not contain: (i) confidential information or trade secrets; (ii) false or misleading statements; (iii) libelous, harassing, abusive, obscene, vulgar, sexually explicit, or racially, sexually, or otherwise objectionable content; or (iv) content unrelated to our Services.
